  1. Definitions

In these Terms & Conditions the following expressions have the respective meanings:

IMPORTANT – PLEASE READ:The following Agreement describes the terms and conditions that apply to your Account (prepaid, loyalty, gift card and other functions). These Terms and Conditions apply to the use of your Card/App and govern the relationship between Bubbleology UK-I Ltd (“Bubbleology”, “we” or “us”) and you. Use of your Card/App will constitute acceptance of these Terms and Conditions. You must therefore read them carefully. Please print a copy of these Terms and Conditions for your records. If there is anything you do not understand, please contact our Customer Services. 

  1. Loyalty Card/App

The Card/App is an electronic money product. When you credit value to your Card/App you will be purchasing electronic money from Bubbleology UK-I Ltd.

Your Card is issued by, and remains the property of, Bubbleology UK-I Ltd. We do not authorise anyone else to sell or distribute the Card. You can only obtain Cards from Bubbleology shops and online viawww.bubbloeologyloyalty.co.uk. 

  1. Using Your Card and App
  2. A) PREPAID CARD AND APP 

You can use your Card or App at any participating shop nationwide. It is not a credit card, charge card or debit card. Before you can use your Card or App as payment method you will need to credit it with funds. Your App loyalty account can be activated simply by signing up and activating your account through the account activation email, a minimum spend of £5 applies for top-ups.  

You can credit and top-up stored value on your Card by cash or credit card at any participating shop. The minimum value you can credit your Card with each time is £1. The maximum credit value you can store on your Card at any time is £100. 

You can check the balance on your Card at any time online or in any participating shop. We will keep a record of all transactions and use reasonable endeavours to check that this balance is correct. You should keep your receipts and check your online statement to ensure that your account balance is correct.

If you are using the Bubbleology Loyalty system available in the United Kingdom and Republic of Ireland, any qualifying purchase you make using the Bubbleology card/app  registered to your account will earn points or balance as if the currency were expressed in GBP. No currency exchange is applied to the value of your purchase for the purpose of determining how many points you have earned, or updating your balance in relation to the number of free drinks that you may redeem. 

After 12 months of inactivity cards will be set to expire and balance removed. The right to refund the cashless balance of the prepaid card is at the discretion of Bubbleology. 

In adding prepayment balance to your Bubbleology loyalty app, you accept that a pre-authentication fee of 10p may be taken from your account when you register payment methods and make transactions. This should be refunded within 5 working days. We will take reasonable measures to ensure that all pre-authentication fees are returned.   

  1. B) GIFT CARD

Your Card is intended for your personal use and, as such, you are not entitled to sell, distribute or otherwise make any commercial use of your Card (including in relation to any promotional commercial activity). 

For the avoidance of doubt, this shall not prevent you from giving a Card as a gift, provided that such gifting is not part of or connected to any commercial activity (including any promotional commercial activity). 

After 12 months of inactivity cards will be set to expire and balance removed. The right to refund the cashless balance of the gift card is at the discretion of Bubbleology. 

  1. C) LOYALTY CARD AND APP

Cards can alternatively be used as loyalty cards to earn rewards and promotions on purchases or individual products. Your Bubbleology Loyalty app is also intended for the purpose of earning rewards and promotions on purchases or individual products. 

Please note that your card must be registered online to enable you to earn and redeem loyalty points. If you are using the Bubbleology loyalty app, you must activate your account through the provided link that will be sent by email to your registered address  after signing up, you will be unable to log in and begin using the app until you do.  

Each User must only use the Account in accordance with the Scheme rules. In order to earn reward points on purchases, the Card/App must be presented at the checkout prior to purchase. 

Reward points cannot be added after the transaction is completed. Each Card/App is personal to the holder or relevant User to whom it is issued and neither the Card/App nor the reward points can be used by or transferred to any other person. The rewards points cannot be used in conjunction with any other promotion or discount. Reward points will not be awarded against the purchase of gift cards/gift vouchers, purchases paid for with vouchers issued under this Scheme or payment for purchases made online. Certain other products may also be excluded from the Scheme or the reward points awarded reduced from time to time at our discretion. Any reward points earned on purchases which are subsequently cancelled or refunded will be deducted from the Card/App. For current reward points earning levels please see in-store or visit www.bubbleologyloyalty.co.uk. 

Reward points on the card and app have no cash value and cannot be exchanged for free drinks or cash. When you have obtained enough points to be entitled to a free drink on the app, the balance equivalent to one regular fruit or milk tea with no extra toppings will be added to your Bubbleology account – this is non-refundable and cannot be exchanged for cash.  

The App is free of charge and can be downloaded from either Apple or Android App stores or, if available, via a QR code that may be found on marketing material within your participating Location. Certain mobile devices may not support the App, in which case you will not be able to use it. The app is also intended for use in the UK and does not support any other currency than GBP.  

If you change mobile devices, you will need to redownload the App in order to access your information. The App is only available with an internet connection and any and all charges incurred during your use of the App are subject to your agreed terms and conditions with your internet or mobile provider. Where there is an option to register for a particular area of the App and you choose or are provided with a user identification code, username and/or password, you should treat this information as confidential. Each registration is for a single user only and is limited to individuals that are acting in a personal capacity and not in the capacity of a company, who have a current and valid email account. Your account is personal, non-transferable and subject to these Terms and Conditions. We apply a limit of one membership per person and registered email address. We reserve the right to disable any identification or password, chosen or allocated, at any time, if in our reasonable opinion we believe you have failed to comply with these terms and conditions. You are responsible for the security of any passwords issued to you. 

The App may be suspended temporarily or permanently and without notice in case of system failure, maintenance or repair or for other reasons beyond our control. We reserve the right to make changes to the App from time to time, to include the removal, modification and/or variation of any elements, features or functions of the App. 

Other than personal information covered under our Privacy Notice, any material you post to the App (where this is possible) shall not be confidential. We shall be free to copy, disclose, distribute, incorporate and otherwise use any material and data, images, sounds, test and other material embodied in the posting or upload for any purpose. You must not post any material on the App that is threatening, offensive, discriminatory, blasphemous, in breach of confidence or privacy or any material that could cause any harm to the App through the use of viruses, logic bombs, malicious software, worms or any similar technical misuse of the App. Any misuse shall be disclosed to law enforcement authorities at our discretion. 

You may cancel your Card and/or delete your App at any time but if you do so, you may forfeit the right to any points and balance that have accumulated on your Account that have not been used. We may ask you to return or destroy the Card and/or delete the App in accordance with our instructions. 

If your smartphone with the App is lost or stolen or if your Card is lost or stolen, you must notify us of this via the customer service email address set out at the beginning of this document  (General). Bubbleology will not be liable for any resulting loss of points or Vouchers. 

We reserve the right to reject any Cards that become unreadable and also to refuse to redeem any points or Vouchers which have been acquired where the Card has, or the balance of points have been acquired, or is suspected to have been acquired, via theft, fraud or any other means that are not in accordance with our Terms and Conditions. If your Card is lost or stolen, Bubbleology will not be liable for any resulting loss 

Bubbleology reserves the right to refund any balance attributed to the loyalty account at their discretion. Loyalty cards, after 12 months of inactivity, will be set to expire and any balance removed. 

Whilst we will not send marketing communications to you via email, push or SMS unless you give us permission to do so, you may receive communications from Bubbleology in relation to our Loyalty Scheme to notify you that a free drink is available to you. You may also receive communications from us to notify you of any changes to your account and information. It remains your responsibility to redeem any reward prior to the expiry date. 

 

To qualify for a free product reward: 

  1. a) This offer applies when you buy nine eligible products in participating UK stores
  2. b) Your free reward can be redeemed for 1 regular drink with no extra toppings other than standard tapioca
  3. c) This offer is not in conjunction with any other offer and is subject to availability
  4. d) This offer has no cash value and cannot be exchanged for cash
  5. e) We reserve the right to withdraw this offer at any time
  6. f) We reserve the right to substitute any product within this promotion if the need arises

 

 

APP LAUNCH OFFER 

The launch offer of 1 free regular fruit or milk tea without extra toppings will be redeemed to customers’ accounts on the last day of the offer.  

To qualify for this offer: 

  1. Customers must have downloaded the app before the last day of the offer
  2. This reward will only be available at participating UK stores and is subject to availability. 
  3. This offer cannot be used in conjunction with any other offers and promotions available on the app or in store. 
  4. This offer cannot be exchanged for cash. 

Bubbleology reserves the right to remove this offer at any time 

 

  1. D) CLICK & COLLECT

At participating Locations, you may be able to order certain products online, with products to be collected by you from the Location via the Click & Collect system. You will collect loyalty stamps on purchases made via the Click & Collect system. If you would like to use the Click & Collect system, you will need to be registered with an Account. Payments may be made using any of the methods listed at our checkout screen, which may include paying online at the time of booking or at the time of collection via normal methods of purchase available at the Location (which may include the Card or App or Cashless System). The acceptance of orders for the products shall be at the entire discretion of Bubbleology. Our acceptance of an order occurs when you receive an on-screen message confirming your order has been placed. Up until this point, we may decline to provide you with the products without giving any reason. In the unlikely event that the goods ordered are not available, you may choose equivalent product(s) of the same value, or we will refund any amounts already paid by you. Unless otherwise stated in writing the prices quoted by Bubbleology on the Website are inclusive of VAT and any other applicable taxes. 

Once your order is placed and is confirmed it is not possible to amend or cancel your order. By submitting your order, you agree that Bubbleology should complete your order. 

 

If the items are not collected, you will still be charged the full price. If any part of the order is missing (and for the avoidance of doubt the following shall also constitute there being a missing product: (i) an alternative product is provided without your approval; and/or (ii) it is agreed with the Bubbleology team member that a product is unfit for consumption) on collection, the customer must let the Bubbleology team member know immediately. We will endeavour to replace the items wherever possible. If we are unable to fulfil any part of your order, we’ll endeavour to refund you for such missing or rejected product via the payment method used to make the payment. Refunds may take up to [5-15] working days to reach your account. We reserve the right to restrict or refuse collection requests without any notice and at any time. Products are supplied only for use as a consumer and not for commercial purposes. We reserve the right to refuse an order that we believe is for commercial usage. 

You agree to comply with any recommendations and guidance given by us relating to the storage and use of the products (For example “Consume by” guidance). 

 

 

  1. Expiry

Your Card does not have an expiry date. However, if you do not use your Card for a period of one year or more, your Card will cease to be valid and any remaining credit value stored on it will expire. Checking the balance on your Card will not constitute use of the Card for these purposes. Expired value cannot be transferred to a new card or redeemed. You will not be able to use your Card once it has ceased to be valid. 

  1. Cancellation

You have the right to cancel your Card at any time by returning it to Customer Services (see details on the website). 

If you wish to cancel your Card, you must contact Customer Services. 

  1. Registering Your Card

To protect the stored value on your Card from loss, theft or damage you can register your Card by following the instructions on the website atwww.bubbloeologyloyalty.co.uk. 

If you need to change any of the details you have registered with your Card, please contact Customer Services; alternatively, you can make changes through the website. 

  1. Loss, Theft, Damage

You should treat your Card like cash in a wallet. If you lose your Card or if it is stolen you may lose any value which is stored on it in the same way as if you lost your wallet. 

If you have registered your Card through the website, you should immediately report any loss, theft, fraudulent or unauthorised use of your Card to Customer Services or on our website. 

In the event of loss, theft, fraud or other unauthorised use of your Card, or if your Card is damaged or malfunctions, we may, at our sole discretion, replace your Card and transfer any credit value stored on it at the time of reporting to a replacement card. Non-exhaustive circumstances in which we may determine, in our sole discretion, that we will not replace your Card include those where we reasonably believe that the notified incident has been caused by your wilful breach of these Terms and Conditions or if there are reasonable grounds for suspecting that you are or have been engaged in fraudulent or other unlawful conduct. Alternatively we may, at our sole discretion, procure a redemption payment in respect of any outstanding value stored on your Card. 

If we agree to replace your Card, a replacement card will be delivered to your home address as registered against the card. 

Replacement cards will be posted to your registered home address only. We reserve the right to charge a replacement card fee for each replacement card in the event that you are issued with more than two replacement cards within any 3 month period. 

If you subsequently find or retrieve a Card which you have reported lost or stolen, you must notify Customer Services immediately. 

  1. Data Protection & Privacy

If you register your Card on the website you will be asked to provide certain personal information, including your name, date of birth, address, contact details and if you top up your Card online, credit card details. We are committed to maintaining the security of your personal information in accordance with the requirements of the General Data Protection Regulation and will take reasonable steps to ensure that your personal data is kept secure against unauthorised access, loss, disclosure or destruction. 

The Privacy Policy will apply whenever you provide us with personal information, and is incorporated by reference into these Terms and Conditions. More information about our Privacy Policy can be found atbubbleology.co.uk/privacy-policy. 

Except as required by law, or in accordance with these Terms and Conditions and the Privacy Policy, your personal information will not be passed to any other persons without your permission. 

Bubbleology reserve the right to move user data collected to alternative service or new module from existing provider. To ensure there is no disruption to the loyalty service provided. 

Bubbleology have the right to terminate the loyalty scheme including all loyalty accounts, prepaid cards & gift cards at any point. This will set all accounts to inactive and remove any associated balances from the account. The user is not entitled to any refund of balance at this time. 

  1. Liability Of Impulse Brands Group Ltd

Neither Impulse Brands Group Ltd, nor any member of its corporate group shall be held liable for any default resulting directly or indirectly from any cause beyond our control, including but not limited to, failure of network services and failure of data processing systems. To the extent permitted by law, all conditions or warranties implied by law, statue or otherwise are expressly excluded. 

Impulse Brands Group Ltd will not be liable to you for: 

  • any loss of income, business, goodwill or profits arising out of this agreement;
  • any unauthorised access to or alteration, theft or destruction of your Card;
  • any unauthorised access to or alteration, theft or destruction of mobile devices with the app downloaded and registered
  • the consequences of any delay or mistake relating to the use of your Card or App caused by any circumstances beyond our control;
  • any loss or damage which was not caused by our breach of this agreement or breach of our legal duty of care;
  • any loss or damage which was not a reasonably foreseeable result of either our breach of this agreement or breach of our legal duty of care. Loss or damage is “reasonably foreseeable” if, at the time we entered into this agreement, such loss was contemplated by you and by us;  or
  • any loss or damage suffered by you as a result of you failing to take reasonable precautions against such loss or damage

This agreement does not affect your statutory rights and must be read subject to those rights. If you require more information on your statutory rights you should contact your local authority Trading Standards Department or Citizens Advice Bureau. 

Impulse Brands Group Ltd does not represent or warrant that your Card will always be accessible or accepted at participating shops. 

The Financial Ombudsman Compensation Service is not applicable to your Card. Impulse Brands Group Ltd does not offer any other compensation schemes to cover losses claimed in connection with your Card. 

  1. Variation & Assignment

We reserve the right to amend or waive any provision of these Terms and Conditions from time to time and at any time, or to terminate the Card program on reasonable notice. The Terms and Conditions applicable to the use of a Card shall at any time be the terms and conditions published on the website (www.bubbleologyloyalty.co.uk) and your continued use of a Card shall constitute your acceptance of such terms and conditions. We will also e-mail you to let you know about changes to these Terms and Conditions. 

We may assign the benefit of these Terms and Conditions to any other company in the same group of companies as Boba Tea Ltd. If we assign the benefit of these Terms and Conditions, your rights will not be affected. 

  1. Entire Agreement; Construction

This agreement (as amended from time to time) constitutes the entire agreement between you and Impulse Brands Group Ltd and supersedes all prior proposals and all other agreements in respect of the subject matter of this agreement. If any provision of this agreement is illegal or unenforceable, that provision will be deleted from this agreement, and the remaining terms will not be affected. 

  1. Governing Law

These Terms and Conditions are governed by English law.
